Terms & conditions
Definitions
These are the terms and conditions governing the provision of show filming services by Wizard Video Productions Ltd, or its subcontractors with the exclusion of any other oral or written statement or agreement whatever its legal character.
a) 'You’ or ‘Your’ refers to the company or individual that completes and signs a booking form or enters into a contractual arrangement.
b) 'We' refers to Wizard Video Productions Ltd & its employees including editors, camera operators and administrative staff
c) A ‘performance’ is a production which takes up one of three slots (Morning, Afternoon or Evening) in which a camera operator can realistically be filming at 3 alternate locations over the course of one day.
d) ‘Media’ is anything in digital format which we require to complete your edit (e.g. Extra Footage, CD containing Music, Programmes, Cast Lists, Images etc...)
Acceptance of order
a) Bookings can be accepted at any time up to the performance date, subject to availability.
b) Bookings can be requested by online form, letter, fax, telephone or email.
c) Bookings are only accepted once You, the Customer, have received an email notification stating the confirmation from Wizard Video Productions Ltd.
d) Bookings are only confirmed once we, Wizard Video Productions Ltd, have received a completed, signed & dated form (sent with email notification detailed above) from you the Customer.
Copyright
a) Wizard Video Productions Ltd undertake not to sell copies of your production, including music or scripts written by your teaching staff or otherwise to any other persons other than your cast, staff and members.
b) We offer to carry out the service specified herein on the understanding that you have all the necessary authority for the production to be made and sold as above, without the obligation for any additional consent from any third party or for any payment by Wizard Video Productions Ltd to any other persons, other than any refund that maybe pre-arranged, stated in the above details.
c) Wizard Video Productions Ltd is not responsible for any copyright fees.
Minimum Sales Agreement
a) The agreed minimum sales for copies sold of each performance filmed is as detailed in your confirmation letter (see document sent with forms.)
b) If the required amount of sales is not achieved you will be invoiced at the agreed net price for the remaining amount of copies.
c) Should you (the school) not reach your minimum sales you will be invoiced for the shortfall at the net price and any refund due for sales achieved will be forfeit.
Filming
a) We require a minimum 1 ½ sq. metres of floor space (with an unobstructed view of the performance area) per camera. If filming in a fixed seating area each kit & operator requires 6 seats (3 seats in each row NOT 6 seats in one row.)
b) On the date/s of the performance/s our allocated Camera Operator will arrive 1 Hour and 30 minutes (For One camera shows) or 2 Hours (For Two camera shows) prior to your curtain up and an extra 30 minutes on top of that where pre show filming has been requested.
c) Wizard cannot be held responsible for late arrivals due to traffic, accidents or weather conditions.
d) The space and time for set up is the minimum required to ensure that we are able to film for you. Anything less and we may miss your curtain time or potentially not be able to film
e) We require access to a power socket and, if available, feed from the sound desk.
f) Wizard Video Productions cannot not be held responsible for issues with sound or picture quality caused by persons other than employees of Wizard Video Productions
g) Wizard Video Productions reserves the right to assign or sub contract its filming/editing services to other appointed and approved personnel.
Editing
a) In off peak times we undertake to edit your productions to the best of our ability within 2 to 3 weeks of your performance/s for single camera productions or 4 to 5 weeks of your performance for multi camera productions.
b) Your edit in peak periods will be allocated to an editor only once your first order has been placed.
c) At peak times Schools that have requested their copies prior to the end of term will be given priority. Once the schools have broken up remaining productions are prioritised by “orders placed date” then “production date” and processed accordingly. Without placing an order we may not, therefore start the edit of your show/s until other priority shows are completed. Two camera shoots incur a much longer turnaround time due to the extra time required to edit different camera angles.
d) Wizard Video Productions Ltd will not be held responsible for delays to editing deadlines due to a lack of response for requested information or media from yourselves
e) Peak Filming/Editing Dates are the four week periods leading upto the end of each school term. Shorter 2 week periods following the end of the School Year and Christmas holidays are also considered peak editing times.
f) If all relevant Media requested by Wizard has not been received within one week of that request with no reason given we will proceed with what is available (even though it could mean a possible loss of quality.)
g) If, on completion of forms for performances during peak times, you do not specify a suitable requested delivery date we will work towards your stated end of term date or, if EOT not completed, next term.
Credits, Cast Lists & Programmes
a) Wizard Video requests that you provide us with an electronic copy of your cast list/programme and if possible artwork. Should you be unable to provide us with an electronic copy we will not responsible for any errors made in the duplication of the cast list from your hard copy & reserve the right to exclude said credits if deemed to be too complex to replicate.
b) Credits must be emailed in a text readable format within 1 week of the show. Otherwise it may not be possible to include them
c) Emailed credits sent prior to the date the edit starts will be used. Anything sent after this date may not be used and any errors incurred due to the use of old information will incur a charge to amend
d) Errors in emailed/electronic copy or any errors found once the typed/scanned document has been approved will incur a charge to amend
Ordering
a) Previews are sent as standard for two camera productions and Unless specifically requested are NOT sent for single camera productions.
b) Requesting Preview copies will incur a delay in the duplication of any previously placed orders
c) Schools that have received a preview will not have their orders duplicated until you have signed and returned your preview letter which should only be completed once you have checked credits, covers, DVD Labelling & chapter points as well as watching the show itself and are happy with the end results.
d) We will not assume to automatically place your, minimum sales, order. Orders will only be placed once your explicit go ahead (either verbal or written) is given.
Complimentary Copies & Refund Payments
a) You will receive complimentary copies based on copies sold. 1st complimentary issued as standard (approved preview copies counted as first complimentary) Sales over: 45 for 2nd - 80 for 3rd - 120 for 4th
b) Your account will be altered as your sales increase and any outstanding copies owed to you will be sent after you confirm that sales are complete.
c) Customers who have requested the payment option 2 on the booking forms will be due £1 for each DVD copy sold unless otherwise requested. Payment will be made by cheque on your confirmation that no further orders are likely to be forthcoming.
d) The refund payment will be made based on DVD payments made. It is your responsibility to ensure that payments received match the required invoice amounts as any underpayments will be deducted from your final refund payment.
Force Majeure
Wizard Video Productions Ltd. shall be entitled to delay or cancel its services or delivery of its products or to reduce the amount delivered if it is prevented from, hindered in or delayed in the provision of services through any circumstances beyond its reasonable control including but not limited to strikes, lock outs, accidents, war, fire, acts of God, extreme weather conditions, reduction in or unavailability of power, break down of plant or machinery or shortage or unavailability of raw materials from normal sources of supply.
Signature
The booking form must be signed and dated by the persons accepting responsibility for guaranteeing our minimum sales agreement and all payments due in pursuit of that agreement. Forms submitted electronically need not be signed but agreement to abide by the terms stated above will be tacit by the deliberate act of completion and return.
